By accessing our website, purchasing our beauty and personal care products, or engaging with our digital platforms, you agree to comply with and be bound by these Terms and Conditions, structured in full compliance with the Information Technology Act, 2000, the Consumer Protection Act, 2019, and the Consumer Protection (E-Commerce) Rules, 2020 of India. These terms govern the operational, legal, and financial transactions carried out between Novus Cosmetic and its consumers. Our priority is to ensure a secure, transparent, and seamless shopping experience while maintaining regulatory compliance regarding data handling, product delivery, intellectual property safeguards, and fair consumer practices. Use of this platform signifies that you are at least 18 years of age or accessing under the supervision of a legal guardian, capable of entering legally valid contracts under the Indian Contract Act, 1872. Novus Cosmetic reserves the operational authority to update, revise, or refine these guidelines periodically to accommodate technological advancements or legislative mandates. 1. Eligibility and Account Registration: To complete purchases or access specific platform features, you must register for an account using authentic and accurate personal details. You remain solely responsible for safeguarding your login credentials and for all activities conducted under your registered account.
   
2. Order Placement and Financial Transactions: All orders placed via Novus constitute an offer to purchase. Transactions must be executed through approved payment gateways, including UPI, debit cards, credit cards, and net banking compliant with Reserve Bank of India (RBI) protocols. Orders are processed upon successful payment authorization.
   
3. Cancellation and Order Withdrawal: In line with Novus policies, you may withdraw, modify, or cancel your order at any time before delivery dispatch occurs. Once an order is handed over to the courier partner, standard return policies apply rather than pre-delivery cancellation.
   
4. Refunds and Payment Reversals: If an eligible pre-delivery cancellation or verified return is processed, Novus Cosmetic will initiate the refund within 5 to 7 business days directly to the original payment source in accordance with standard banking cycles.
   
5. Shipping, Delivery, and Risk of Loss: Novus aims to deliver products within the estimated transit timelines across India. Risk of loss and title for items purchased pass to you upon successful physical delivery by our partnered logistics providers.
   
6. Product Formulations and Skin Safety: Product descriptions, ingredients, and usage guidelines are provided for informational convenience. Because cosmetic products interact uniquely with individual skin profiles, users must perform a 24-hour patch test before full application. Novus Cosmetic is not liable for personal allergic reactions when products are used contrary to labeling.
   
7. Pricing and Typographical Inaccuracies: Novus Cosmetic strives for complete accuracy across product descriptions and price listings. However, in the rare event of a typographical error, system glitch, or inaccurate pricing, we reserve the right to cancel affected orders prior to shipping and issue a full refund.
   
8. Service Availability and Downtime: We make continuous efforts to ensure uninterrupted access to the platform; however, we do not warrant that our website will operate error-free or without scheduled maintenance intervals, network interruptions, or server downtime.
   
9. Intellectual Property and Copyright Governance: All trademarks, product packaging designs, visual graphics, website copy, formulas, and imagery associated with "Novus" and "Novus Cosmetic" are protected intellectual property under the Indian Copyright Act, 1957, and the Trade Marks Act, 1999. Commercial reproduction, modification, unauthorized adaptation, or public redistribution without prior written consent is strictly prohibited.
   
10. Permitted Personal and Non-Commercial Use: Platform content is made available solely for individual, non-commercial evaluation and purchasing. Any programmatic scraping, data mining, framed reproduction, or commercial exploitation of Novus platform assets without authorization will invite legal action under applicable Indian laws.
    
11. User Conduct and Prohibited Activities: Users shall not host, display, upload, or transmit any content that is unlawful, harmful, defamatory, vulgar, hateful, racially offensive, invasive of another's privacy, or constitutes spam, unsolicited advertising, chain letters, or platform tampering.
    
12. Account Suspension and Termination: As mandated by the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, Novus Cosmetic reserves the unilateral right to suspend, terminate, or delete user accounts without prior notice if fraudulent transactions, bot usage, harassment, or violations of Indian law are detected.
    
13. Third-Party Integrations: The platform may incorporate links or integrations with external payment gateways, courier tracking tools, or social channels. Novus Cosmetic exercises no administrative control over third-party practices and holds no liability for their terms or privacy mechanisms.
    
14. Grievance Redressal Mechanism: Pursuant to the Information Technology Act, 2000, and the Consumer Protection (E-Commerce) Rules, 2020, users can submit compliance concerns, delivery disputes, or service complaints to our designated Grievance Officer at grievance@novuscosmetic.com, with resolutions acknowledged within 48 hours and resolved within 30 days.
    
15. Governing Law and Jurisdiction: These terms are interpreted and enforced exclusively under the laws of the Republic of India. Any legal dispute, arbitration, or statutory claim arising out of these conditions or your use of Novus shall be subject to the exclusive jurisdiction of the competent civil courts located in India.
